Definitions
- Service provider means Laurea University of Applied Sciences when it is providing the Service for general public.
- Service means the Renderfarm.fi service offered by Laurea University of Applied Sciences. The Service is offered as limited Beta version and some features described in this document may not be available.
- Member means individual or organization that donates their computing resources to the Service.
- Animator is a person or entity who is using the Service for rendering animations who is entitled to use the Service in accordance with this agreement.
Service description
The Service is designed to aid in the rendering of complex resource demanding animations. This can be achieved with distributed computing resources donated by Service Members. Members donate the resources by downloading and installing client software to their computers. The Service can share tasks to computers with client software that automatically uses the computers resources when the computer is in idle mode. The Service can be used under terms of use which must be accepted before registering for the Service.
Submitting projects
Animators can submit their 3D animation projects to the Service. Service provider may define the nature and size of the project and the used programs and programming languages.
Responsibilities of the Service provider
The Service Provider has the right to cancel the Service and terminate this agreement immediately without any prior warning. In this case the Service Provider reserves the right to delete the User’s account and all information without a separate notice. The Service Provider may deny the publication of any material it considers inappropriate and take such material down (e.g. pornographic or violent content). The Service Provider does not guarantee the operation of the Service or any services reached through the Service. The Service Provider is not liable for any malfunctions, technical errors, and resulting interrupts in the Service. The Service Provider is neither liable for the change or loss of data in the Service. The Service Provider aims to keep the functionality of the Service error-free. The Service is provided “as is” and any express or implied warranties, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose are disclaimed. In no event shall the Service provider be liable for any direct, indirect, incidental, special, exemplary, or consequential damages (including, but not limited to, procurement of substitute goods or services; loss of use, data, or profits; or business interruption) however caused and on any theory of liability, whether in contract, strict liability, or tort (including negligence or otherwise) arising in any way out of the use of this Service, even if advised of the possibility of such damage. Service provider doesn’t have to accept any projects to the Service. Service provider may require a separate audition of the submitted projects before they are qualified to use the Service resources. Service provider makes no warranties or representations of the time the audition may take or of the commercial grade or nature of the finished work. The Service provider does not give warranties to the members of the rendered projects, their safety or content. Except to the extent required by applicable law, in no event will the Service provider be liable to members or animators on any legal theory for any damages arising out of the use of the Service or works created or distributed through with it. The Service provider is facilitating the distributed rendering but takes no party in rendering the animations or defining how the animations are rendered. The Service provider makes no warranty whatsoever in connection with the rendered Works, the time it takes to render them or the completion of the rendering.
Information page
Service provider assigns a permanent information page for each project. The information page consists of relevant metadata. Metadata may be provided by the animator or it may be collected automatically. Metadata includes information including but not limited to (if available) the name or pseudonym of the Animator, the license that is used to license the rendered work, the license that is used to license the elements of the rendered work, the time stamp of the project submission, the contact information of the animator, the level of the audition, a list of participating members who have rendered frames to the project and the size of the rendered project.
Copyrights
The Service is built in a way that requires sharing of 3D models and other copyrighted material to the members. The Service provider and the members are granted a royalty free, irrevocable, global license to reproduce the work only for the project purposes and for marketing purposes of the Service including but not limited to the use of still images and under 30 second video clips on the Service Web site and on rendering software screensaver. The rendering of the frames does not constitute a creative work. Members don’t get copyright to rendered frames. The copyrights to all copyrighted material including but not limited to 3D models, rendered frames and textures remain with the rights owner. All rights not expressly granted by the rights owner are reserved. Animator may define that upon completion the resulting animation or elements used in it are distributed with a certain license. The Service Provider respects rights owners and expects its users to do so as well. Service Provider is not actively monitoring the content submitted to the Service for copyright infringements. Service Provider is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to content submitted by the users of the Service. Each information page includes a link for reporting infringing content to Service Provider. Service Provider takes copyright and privacy violations seriously. Users are not allowed to use the Service to publish material that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post the material and to grant Service Provider all of the license rights granted herein. Accounts that are repeatedly used to publish infringing content will be terminated. Service Provider may remove user submissions or block users’ access to the Service in violation of these terms of use at any time, without prior notice and at its sole discretion.
Jurisdiction
This agreement is governed by Finnish law without respect to its conflict of laws principles. Any disputes arising in whole or in part from this agreement or the contractual relationship based on this agreement are solved primarily through negotiations. If negotiations do not help, the dispute shall be settled by the Helsinki district court. However, the Service Provider reserves a right to seek injunctive reliefs in other courts of competent jurisdiction.
